1. Agreement

By accessing or using the website at monolithai.net (the “Site”), the AI assistant “Aria”, our voice receptionist services, or any related software (collectively, the “Services”), you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services. The Services are operated by Monolith Ai LLC, a Maryland limited liability company doing business as “Monolith Concierge” (“Monolith”, “we”, “us”).

2. Nature of the Services — Not Professional Advice

Monolith provides AI-powered customer engagement infrastructure. The Services do not provide medical, legal, financial, tax, or other professional advice. Aria is an artificial-intelligence assistant, not a licensed professional, and may produce inaccurate, incomplete, or out-of-date information. Do not rely on the Services for any decision that requires professional judgment. Always consult a qualified professional for medical, legal, or financial matters.

3. No Protected Health Information

The Services are designed to operate outside the scope of Protected Health Information (PHI) as defined under HIPAA. Do not submit PHI, sensitive personal data, payment card numbers, or government identifiers through the chat or voice channels. If you submit such information despite this notice, you do so at your own risk and authorize us to process it solely to respond to your inquiry.

4. AI Disclosure

Communications with Aria — whether by chat or voice — are with an artificial-intelligence system, not a human. Calls and chat sessions may be recorded, transcribed, and stored for service operation, quality improvement, and model evaluation. By using the Services you consent to such recording and processing.

5. Acceptable Use

You agree not to: (a) use the Services for unlawful purposes; (b) attempt to reverse engineer, probe, or disrupt the Services; (c) submit content that is defamatory, harassing, or infringing; (d) use the Services to make medical, legal, or financial decisions without independent professional verification; or (e) impersonate any person or entity.

6. Intellectual Property

The Site, Aria, the Monolith name and logo, and all related software, content, and documentation are owned by Monolith or its licensors and are protected by applicable intellectual-property laws. No license is granted except as expressly stated in these Terms or a separate written agreement.

7. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. MONOLITH DOES NOT WARRANT THAT ARIA’S OUTPUTS ARE ACCURATE, COMPLETE, OR FREE OF BIAS OR ERROR.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MONOLITH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL CUMULATIVE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Monolith from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your use of the Services or your violation of these Terms.

10. Telephone & SMS/Text Messaging Consent

By opting in to text messages through a form on our website (an optional, unchecked-by-default checkbox presented where you enter your phone number), you consent to receive SMS text messages from Monolith Concierge, such as appointment confirmations and appointment reminders. By initiating a call to our published phone number, you consent to interact with an automated AI voice agent and to the recording, transcription, and storage of that communication.

11. Termination

We may suspend or terminate access to the Services at any time, with or without notice, for any reason, including violation of these Terms. Sections 2–10 and 12–14 survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Maryland, United States, without regard to its conflict-of-laws rules. Any dispute shall be brought exclusively in the state or federal courts located in Montgomery County, Maryland, and you consent to personal jurisdiction in such courts.

13. Changes

We may update these Terms from time to time. Material changes will be reflected by updating the “Last updated” date at the top of this page. Continued use of the Services after changes constitutes acceptance of the revised Terms.
